Terms of Service

Qualified Hires ("QH", "we", "us") is hiring software built for home service businesses. It helps you post jobs, collect applications, manage candidates, and automate follow-up messages.

When we say "you" or "your," we mean the business or person using QH.

You must be 18 or older. You must be using QH for a real business — not to scrape data, test competitors, or anything shady.

If you're a recruiter managing QH for other companies, the same rules apply to you and to any client you onboard.

You're responsible for your account. Keep your password safe. If someone gets into your account because you shared your password, that's on you.

You can have one account per person. Don't create fake accounts to game the referral program or get extra free trials. We'll close them.

• Post real job listings for real open positions
• Collect and manage applications from real candidates
• Send automated text messages to applicants who applied through your careers page
• Share your referral link with real colleagues and clients
• Export your own data at any time

• Post fake jobs or collect applications with no intent to hire
• Use QH to spam people who didn't apply to your jobs
• Scrape, copy, or sell data from the platform
• Reverse-engineer or copy QH's software
• Use one account to manage another company's hiring without being a registered QH Partner
• Create multiple accounts to get multiple free trials

QH can send text messages to your applicants on your behalf. By using this feature, you agree that:

• You will only text people who applied through your QH careers page (that application = their consent)
• You will honor opt-outs — if someone replies STOP, you will not contact them again via SMS
• You will not use QH to text people who did not opt in
• You are the "sender" under TCPA law — not QH. You are responsible for complying with texting laws in your state and country.

If you use QH to spam people, we'll shut down your account and you'll be responsible for any legal consequences.

When someone applies to your job, their information (name, phone, email, answers) is stored in QH and belongs to you. We process it on your behalf.

You agree to:

• Only use applicant data for hiring decisions
• Not sell applicant data to anyone
• Delete applicant data if someone asks you to
• Follow your local privacy laws (CCPA, GDPR, etc.) — we'll help where we can, but you're the responsible party

We do not sell your applicants' data. Ever.

New accounts get 28 days of Owner Operator features for free. No credit card required.

After 28 days, if you haven't subscribed, your account moves to the Free plan. Your data stays. You don't lose anything — you just lose access to paid features.

Plans are billed monthly. You can upgrade, downgrade, or cancel anytime.

Cancellation: When you cancel, you keep access until the end of your current billing period. We don't offer refunds for partial months.

Disputes: If you think you were charged incorrectly, email us within 30 days and we'll sort it out. Chargebacks filed without contacting us first may result in account suspension.

If you refer someone to QH and they subscribe, you get a credit on your next invoice equal to your full monthly plan cost. The person you refer gets one free month.

Rules:

• You cannot refer yourself
• Credits only apply after your referral's first invoice is paid and 14 days have passed (in case of disputes or chargebacks)
• If your referral disputes a payment, your credit may be reversed
• We reserve the right to cancel referral credits if we detect abuse (fake signups, self-referrals, coordinated rings)

If you use QH as a recruiter managing clients, you agree to:

• Only create client accounts for real businesses you have a relationship with
• Not use the platform to farm referral credits through fake client accounts
• Be responsible for your clients following these terms

The competitor intelligence feature shows publicly available review data scraped from third-party sites. It is for your own internal hiring research only.

You agree not to:

• Use this data to harass competitors or their employees
• Republish or sell this data
• Use it in any way that violates the source platform's terms

We work hard to keep QH running. We don't guarantee 100% uptime. If something breaks, we'll fix it as fast as we can.

We're not responsible for losses caused by downtime, bugs, or data issues — but we'll always do right by you if something on our end causes a real problem. Just reach out.

We can close your account if you:

• Violate these terms
• Abuse the platform, referral program, or free trial
• Don't pay your bill after reasonable notice
• Use QH to harm applicants or other users

You can close your account anytime. Your data is available for export for 30 days after closure.

QH is a tool. You make the hiring decisions. We are not responsible for who you hire, fire, or reject.

We are not liable for any indirect, incidental, or consequential damages. Our total liability to you is capped at the amount you paid us in the last 3 months.

If we make significant changes, we'll notify you by email or in-app at least 14 days before they take effect. Continued use after that = acceptance.

These terms are governed by the laws of the State of Washington, USA. Disputes go to binding arbitration in Whatcom County, WA — not court, unless we both agree otherwise.
